No Bodoni Typography font and font software license

This package contains fonts & font software and related documentation. The term "software" shall also include any upgrades, modified versions and copies of the software licensed to you by No Bodoni Typography which grants to you a non-exclusive license to use the software and documentation, provided that you agree to the terms of this license.

Using and/or installing No Bodoni fonts and/or font software means you agree to the following terms of the user license. If you do not agree with the terms and conditions of this agreement, return this product, along with the rest of the package, to No Bodoni Typography.

1.A. Copyright: The Software is owned by George E. Thompson and No Bodoni Typography and its suppliers. The structure, organization and code of the fonts or software are the valuable trade secrets of George E. Thompson and No Bodoni Typography. The fonts & font software are also protected by United States Copyright Law and International Treaty provisions. You must treat the software as any other copyrighted material such as a book or piece of music. You may not copy the software or the documentation except as set forth in the license. Any copies that you are permitted to make pursuant to this agreement must contain the same copyright and other proprietary notices that appear on or in the software. You also agree not to modify, adapt, translate, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the software, nor will you knowingly allow anyone else to do so or supply anyone else with this software so that they may do so. Any manipulations, additions or transformations you make to the font or softw+are using font manipulation tools such as Fontographer, FontLab, etc. must have prior written approval of George E. Thompson and No Bodoni Typography. Trademarks shall be used in accordance with accepted trademark practice, including identification of trademark owner's name. Trademarks can only be used to identify printed output produced by the software. Such use of any trademark does not give you any rights of ownership in that trademark. Except as stated above this agreement does not grant you any intellectual property rights in the software.

1.B. Intellectual property: You acknowledge that any and all trademarks, trade names, intellectual property and material, printed materials and especially the typefaces, fonts and font software are the sole property of No Bodoni Typography & George E. Thompson, and that you will not infringe on these intellectual property rights. You agree to credit George E. Thompson and No Bodoni Typography as the owner, trademark and copyright owner of the typefaces, fonts and font software whenever and wherever credits are shown or needed. Failure to do so means you terminate this license and will return all materials to No Bodoni Typography.

2.A. Backup copies: No Bodoni fonts and font software may not be duplicated in any form except for archive / back up purposes. Up to three (3) individual copies may be made for archival or backup purposes including backups made to online servers.

2.B. Not permitted copies: No Bodoni Typography fonts, font software, documentation and / or printed material may not be rented, leased, sub-licensed or loaned to another person, organization, company or entity. Anyone found to possess such rented, leased, sub licensed or loaned copies of the software and anyone who rented, leased, sub-licensed or loaned the software will be prosecuted to the full extent of the law.

3.A. Transfer: You may transfer all your rights to use the software to another person or legal entity provided that you transfer this agreement, all copies, updates and prior versions of the software, and all documentation to such person or entity and that you retain no copies, including copies stored on a computer.

4.A. Single user license: Each font may be installed on up to five (5) CPUs and printers or output devices (output device including, but not limited to, laser printers, thermal printers, Linotronic image setters, rasterizer, dot-matrix printer, video display terminal or any device which generates display based on the font software and/or font outlines.

4.B. Service Bureaus / Printers: Single copies of individual fonts and font software may be provided to your printer or service bureau only as needed to output jobs. Your printer or service bureau may not keep archive copies under any circumstances. It is preferable that you provide jobs a downloadable PostScript which do not require them to obtain the fonts.

The primary user of each computer on which the software is installed or used may also install the software on one home or portable computer where both computers are used for the same or similar business purposes. However, the software may not be used on the secondary computer by another person at the same time the software on the primary computer is being used unless the second computer falls within the five (5) CPU limit.

5.A. Multi User license: Multiple (more than five (5) CPUs or output device) installations of our fonts or font software require a multi-use site license. Please contact support@nobodoni.com for licensing terms.

5.B. Multi-User License Upgrade Schedule: Each licensee, company, location and/or entity must purchase a separate license, starting with the first output device (see Single User above). The upgrade price for a Multi-User license is calculated as a percentage of the original price of the software and will be negotiated according to the relative circumstances.

5.C. Provided the software is configured for network use, install and use the software on a single file server for use on a single local area network for either (but not both) of the following purposes; (1) permanent installation onto a hard disk or other storage device of up to the permitted number of computers; or (2) use of the software over such network, provided the number of different computers on which the software is used does not exceed the permitted number of computers allowed by the license.

6.A. Warranty: No Bodoni Typography makes no warranties express or implied as to merchantability, fitness for a particular purpose, or otherwise. Without limiting the forgoing, No Bodoni Typography shall in no event be liable for any direct, indirect, consequential or incidental damages, including damages from loss of business profits, business interruption, loss of business information arising out of the use or inability to use the product.

6.B. If the Software does not perform substantially in accordance with the documentation, the entire and exclusive liability and remedy shall be limited to either, at No Bodoni Typography's option, the replacement of the software or the refund of the license fee you paid for the software.

7.A. Support, embedding issues: No Bodoni is responsible for technical support of its officially distributed fonts only and is not responsible for modified and/or regenerated software or software obtained in violation of this license. All No Bodoni fonts are embeddable for use in Adobe PDF documents and other similar uses that do not violate the terms of the contract.

8.A. Violation & terminations: Any violation by you of this agreement shall cause this license to be terminated. In the event of termination, and without limiting any other remedies which may be available against you, you must immediately return the font software to No Bodoni Typography and certify that no copy remains in your, or anyone else's possession.

8.B. Governing Law and General Provisions: This agreement will be governed by the laws in force in the State of Illinois excluding the application of its conflicts of law rules. This agreement will NOT be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application “of which is expressly excluded. If any part of this agreement is found void and unenforceable, it will not affect the validity of the balance of the agreement, which shall remain valid and enforceable according to its terms. You agree that the software will not be shipped, transferred or exported into any country or used in any manner prohibited by the United States Export Administration Act or any other export laws, restrictions or regulations. This agreement shall automatically terminate upon failure by you to comply with its terms.

PostScript and PDF are registered trademarks of Adobe Systems Inc. Fontographer and FontLab are registered trademarks of FontLab Ltd.

NO BODONI TYPOGRAPHY PRIVACY POLICY

No Bodoni is committed to our visitors’ and participants’ privacy. We do not collect any clickstream or viewing data from users of the site beyond the standard use logs provided by our ISP. Any information gleaned from the use logs is not retained nor is any use made of it beyond our own resource allocations. We like to see how many visitors we had when and where they were from, that’s all. The logs don’t show individual IP addresses (or if they do we’re not aware of it).

Personal Information
In using our services and / or products you may be asked to provide certain personal information about yourself, such as your name, company name, e-mail address and certain information about your preferences. You may also include such information when contacting us (and you may not be aware of it) as part of your e-mail message. This information is only used by No Bodoni to communicate with you concerning its products and services. We won’t send you anything you don’t want.

We do reserve the right to share this personal information with MyFonts.com when you are purchasing or have purchased our typefaces from MyFonts.com in case of any problems that may arise from those purchases or typefaces. This will only be to facilitate any resolution of such problems and will never be used or shared for marketing or advertising purposes. In other words we’ll only use it if we need to fix something.

Under no other circumstances will we share your personal information with anyone. We do not share any of personal information with other companies, organizations, institutions or third parties. We do not share this information between users.

We will maintain this personal information as securely as possible, and take steps to ensure its security. Due to the open nature of the Internet No Bodoni cannot guarantee that e-mail communications between you and No Bodoni are completely secure. No one else can guarantee it either.

Cookies
We don’t use cookies. If you have a really good recipe I might try it, but frankly I'm more of a creme brulle / ice cream fan.

Opt-In / Opt-Out
If you wish us to delete any of the information we have about you we will do so if you notify us. We probably don't have any anyway. No kidding.

By visiting this site or receiving services or communications from us, you signify your acceptance of our current Privacy Policy as stated here.
